Privacy Policy
The Harfush Soccer Programs offers young soccer enthusiasts an opportunity to
enhance their skills and love for the game. The sessions focus on technique, agility,
speed, endurance, and strength, led by Inaki Harfush, an experienced soccer player
with a background playing in England, Mexico, and USA. Despite competitive pricing,
the sessions promise comprehensive skill development, including shooting technique, footwork, passing, offensive and defensive maneuvers, and overall game knowledge. It suits those on club or school teams or aiming to join one. Our coaching staff is looking forward to working with your soccer player. There is a 24hr refund policy before session occurs.
I hereby give permission for my child to participate in Harfush Soccer
Programs(HSP). I assume all risks regarding the programs in which my child will
participate. I release, indemnify, and agree to hold Harfush Soccer
Programs(HSP) and its affiliates harmless from any liability that may arise from
participation in the programs organized by HSP. I understand that HSP will not
distribute my details to any third parties. I hereby authorize HSP to use my child's
name or pictures of him/her participating in the program for marketing purposes.
By signing below, I attest that the information entered above is correct and that I
agree to HSP's terms and conditions.
I HEREBY AGREE AND CONSCIOUSLY KNOW THAT THE OWNER AND
ADMINISTRATOR OF THIS EVENT IS A MINOR. I KNOWINGLY AND FREELY
ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM
THE NEGLIGENCE OF THE RELEASED PARTY or others, and assume full
responsibility for my child's/ward’s participation.
IN CONSIDERATION OF my child/ward, being allowed to participate in any way at
Harfush Soccer Programs (“Harfush Soccer Programs” or “Released Party”) in
the sports, sports training, exercise, and fitness-related events and activities
occurring on the premises of Harfush Soccer Programs located at 3455 Newman
Blvd, Frisco, TX 75034 or any locations used (the “Activities”), the
undersigned acknowledges, appreciates, and agrees that:
The risk of injury to my child/ward from the activities involved in these programs
is significant, including the potential for permanent disability and death, and
while particular rules, equipment, and personal discipline may reduce this risk,
the risk of serious injury does exist.
1) FOR MYSELF, SPOUSE, AND CHILD/WARD, I KNOWINGLY AND FREELY
ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM
THE NEGLIGENCE OF THE RELEASED PARTY or others, and assume full
responsibility for my child's/ward’s participation.
2) I willingly agree to comply with Harfush Soccer Program’s stated and
customary terms and conditions for participation. If I observe any unusual
significant concern in my child's/ward’s readiness for participation and/or in the
program itself, I will remove my child/ward from participation and bring such
attention to the nearest official immediately. This Minor Waiver/Release does not
include a term or time restriction and continues in perpetuity in full force and
effect.
3) I, for myself, my spouse, my child/ward, and on behalf of my/our heirs, assigns,
personal representatives, and next of kin, HEREBY RELEASE AND HOLD
HARMLESS Harfush Soccer Programs, its members, directors, officers, officials,
agents, employees, volunteers, other participants, sponsoring agencies,
sponsors, advertisers, and if applicable, owners and lessors of premises used to
conduct the event WITH RESPECT TO ANY AND ALL INJURY, DISABILITY,
DEATH, or loss or damage to person or property incident to my child's/ward’s
involvement or participation in these programs, WHETHER ARISING FROM THE
NEGLIGENCE OF THE RELEASED PARTY OR OTHERWISE, to the fullest extent
permitted by law.
4) I UNDERSTAND AND ACKNOWLEDGE that the Activities in which my
child/ward engages are voluntary and bear certain anticipated and unanticipated
risks that could result in injury, death, illness, disease, and/or physical or mental
damage to my child/ward, other persons and property. These risks include:
All risks inherent in the Activities, including risk of injury or damage to my
child/ward and property, death, dismemberment, disfigurement, and partial or
total destruction of property; The acts, omissions, negligence, or fault in any degree of Harfush Soccer Programs; Latent or apparent defects or conditions located at the premises of Harfush Soccer Programs, equipment or property supplied by Harfush Soccer Programs or other persons or entities at Harfush Soccer Programs; The condition of any exercise equipment, exercise machines, and property located at Harfush Soccer Programs; My child’s/ward’s own acts and omissions, as well as my child’s/ward’s physical condition and skill level, the acts or omissions of Harfush Soccer Programs, and the acts or omissions of other persons engaging in the Activities; and
First aid, emergency treatment, or other services rendered by Harfush Soccer
Programs or others.
5) I UNDERSTAND AND ACKNOWLEDGE that the above list is not complete or
exhaustive and that other risk, known or unknown, identified or unidentified,
anticipated or unanticipated, whether incurred during the course of any of the
Activities or otherwise at Harfush Soccer Programs, could also result in injury,
death, illness, disease, or damage to my child/ward, other persons, and property.
6) I agree to indemnify and hold harmless Harfush Soccer Programs, including,
but not limited to, its members, directors, officers, officials, agents, employees,
and volunteers harmless from and against any and all suits of any nature or kind
caused by, resulting from or in any way connected with the Activities conducted
on Harfush Soccer programs’ premises whether or not caused by the active or
passive negligence or other fault of Harfush Soccer Programs.
7) I UNDERSTAND AND ACKNOWLEDGE that no major medical or accident
insurance benefits will be provided to me or my child/ward while engaging in any
Activities. I certify that I and my child/ward have sufficient health, accident, and
personal liability insurance to cover any bodily injury or property damage that
myself or my child/ward may incur while participating in the Activities and to
cover bodily injury or property damage caused to another party as a result of my
child’s/ward’s participation in the Activities. If my child/ward or I have no such
insurance, I certify that I or my child/ward am capable of personally paying for any
and all such expenses and liability. I understand and acknowledge that the
Activities require significant physical exertion and require my child/ward to be in
a healthy physical condition sufficient to handle the physical exertion required for
the Activities. I acknowledge and agree that Harfush Soccer Programs shall have
no obligation to judge or determine my child’s/ward’s physical condition or ability
to handle the physical requirements of the Activities. I FURTHER ACKNOWLEDGE
that my child/ward is in good physical and mental health and is
not suffering from any condition, disease, or disablement that would or could
potentially affect my child’s/ward’s participation in the Activities.
8) I, for myself, my spouse, my child/ward, and on behalf of my/our heirs, assigns,
personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD
HARMLESS the above Released Party from any and all liabilities incident to my
child’s/ward’s involvement or participation in these programs and Activities,
EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTY, to the
fullest extent permitted by law. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY ACCEPTING IT, AND ACCEPT IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. VERIFIABLE PARENTAL CONSENT FOR COLLECTION, USE, AND DISCLOSURE
OF CHILD’S PERSONAL INFORMATION - READ BEFORE SIGNING
I, the undersigned (“Parent/Guardian”), consent to photography and videotaping
by Harfush Soccer Programs (“HSP”) employees and its/their release,
publication, exhibition, or reproduction of my child (“Child” or “Minor
Participant”) to be used for purposes including, but not limited to, public
relations, news articles or telecasts, education, advertising, marketing,
fund-raising, inclusion on HSF’s website, HSF’s social media pages, and HSF’s
Instagram. Pursuant to the Children’s Online Privacy Protection Act (“COPPA”), HSP, wishes to collect personal information from the Child. The “personal information” of the Child includes images, photographs, video recordings, and video tapings of the Child while participating in activities at HSP. Parent/Guardian’s consent is required to collect, use, and disclose the Child’s personal information. Parent/Guardian consents to HSP’s collection, use, and disclosure of the Child’s personal information by signing this document. Parent/Guardian has the option to consent to the collection and use of
the Child’s personal information without consenting to disclosure of the Child’s
personal information to third parties. Parent/Guardian’s failure to consent to
HSP’s collection, use, and disclosure of the Child’s personal information will not
prevent the Child from participating in activities on the HSP premises. HSP will
not require a child to disclose more personal information than is reasonably
necessary to participate in an activity as a condition of participation.
Parent/Guardian can review the Child’s personal information, ask for it deleted,
and refuse to allow any further collection, use, or disclosure of the Child’s
information. HSP has established and maintains reasonable procedures to
protect the security and integrity of the personal information collected from the
Child. If the Parent/Guardian does not wish to provide consent for HSP’s
collection, use, and disclosure of the Child’s personal information or seeks to
revoke previously granted consent, Parent/Guardian must contact HSP at (469)
954-5192 and request to speak to Inaki Harfush, or by e-mail at
harfush.business@gmail.co Parent/Guardian releases HSP, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, or publication of said photographs, videotapes, or computer images involving the Child. Parent/Guardian waives all rights he/she may have to any claims for payment or royalties in connection with any exhibition, televising, or other
publication of these materials, regardless of the purpose or sponsoring of such
exhibiting broadcasting or other publication. All negatives and positives, whether
prints, film, or video, are the property of HSP or the person or entity designated
by it, solely and completely.
I HAVE READ THIS RELEASE, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND
THAT I ACCEPT IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
